§1Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Savmira, a brand of The Nelson M Group LLC ("Savmira," "we," "us"). They govern your use of savmira.com and related services, such as email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. Anyone who does not agree to these Terms must stop using the Services.

§2What Savmira is, and is not

Savmira is an information service. We publish general, plain-language data about how clinical research works, how to read a study listing, what informed consent means, and which inquiries to ask a study team, and let visitors opt in to related updates. We never give medical advice, diagnosis, or treatment, do not run, recruit for, or enroll people in clinical studies, and do not match or refer people to studies or research sites, and we do not share your details with study sponsors, research sites, recruiters, pharmaceutical or device companies, lead-generation companies, or any other partners.

• Decisions about your health and about taking part in any research are yours. Reading our content does not obligate you to do anything.
• Your doctor and the study team, not Savmira, decide whether a study is right for you and explain its risks, procedures, and conditions.
• Every study is different. We do not guarantee that any study is safe, suitable, or open to you, or that you will qualify for or benefit from any research.

§3Eligibility

You need to be 18 or older, located in the United States, and able to form a binding contract before using the Services, and the data you submit must be your own or that of a person who authorized you to submit it.

§4Your information and accuracy

You promise that what you submit is accurate and up to date, and you will update it if anything changes. The mobile number you enter must be one you own or have authority to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

§5Communications and text-message consent

You agree, if you opt in, to receive email from us and, only for the boxes you check, automated text messages as outlined in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. §6Text messaging: rates, frequency, STOP and HELP

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-289-1649. Also, please message HELP to any of our numbers to receive help or information about the number.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

§7Acceptable use

The next are prohibited: (a) submitting false or misleading information, or data about someone else without authority; (b) unlawful, fraudulent, or abusive use of the Services; (c) disrupting the Services or attempting unauthorized access; (d) using bots or automation to submit forms; (e) copying, scraping, or reselling our content without permission; and (f) impersonating a person or entity. Breaking these rules may lead us to suspend or end your access.

§8Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, hospitals, or patient organizations) are managed by third parties, not by us. We do not recommend any product, plan, or provider, and we are not answerable for their conduct, content, or results. Your relationship with any doctor or study team is between you and them.

§9Intellectual property

The Services, including the Savmira name, logo, text, graphics, and design, are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial purposes. Photographs on the Site are used under their respective free-use licenses.

§10Disclaimers

The services and all content are offered "as is" and "as available," with no warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We make no promise that the services will run without interruption or error, be secure, or that messages will arrive, or arrive on time.

Savmira does not offer financial, legal, or tax advice, and makes no representation about any medical outcome, study result, or eligibility.

§11Limitation of liability

As far as the law allows, Savmira and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health or research decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Not every jurisdiction allows these limitations, and some of them may therefore not apply to you. No provision of these Terms limits liability where the law forbids limiting it.

§12Indemnification

You agree to hold The Nelson M Group LLC, its affiliates, and its personnel harmless, and to indemnify them, for claims, damages, and expenses (sensible attorneys' fees included) arising from your violation of these Terms, from misuse of the Services, or from giving a phone number or other details that you were not authorized to provide.

§13Disputes, governing law, and arbitration

Informal resolution first. Before filing a claim, please get in touch at [email protected] and let us try to resolve it within 30 days.

Binding arbitration. Except for small-claims matters and claims for injunctive relief for intellectual-property misuse, any dispute between you and Savmira or The Nelson M Group LLC arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in your county of residence or by video or phone, at your choice. The arbitrator may award the same individual relief as a court, and judgment might be entered in any court of competent jurisdiction.

Class-action waiver. Subject to relevant law, you and Savmira agree to proceed only on individual claims and give up the ability to participate as a plaintiff or class member in any class, collective, or representative action.

Opt-out. To opt out of arbitration within 30 days of first accepting these Terms, email [email protected] and include "Arbitration Opt-Out" as the subject, along with your name and mobile number.

Governing law. Governing law: the Federal Arbitration Act and the laws of the state in which The Nelson M Group LLC has its principal place of business, without regard to conflict-of-law rules. Except as the arbitration clause provides, exclusive jurisdiction lies with the state and federal courts based in that state.

§14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. At our discretion we can suspend or terminate access, including for violations of these Terms. Provisions that are meant to outlast termination (disclaimers, limitation of liability, indemnification, and disputes among them) will do so.

§15Changes

We can amend these Terms by posting a new version with a new "Last updated" date; if you keep using the Services after the effective date, you accept the amended Terms. We will give legally needed notification of material updates.

§16General

The entire agreement between you and us on this subject consists of these Terms, the Privacy Policy, and the SMS Terms. Should any part be found unenforceable, the rest continues in effect, and a failure by us to enforce a provision is not a waiver. Assignment by you requires our consent; we may assign these Terms in a merger or sale of the business.
